Photos from Facebook/social media

I am maintaining 2026 Antipolo's 2nd congressional district special election, and each major candidate save one has a photo from Facebook tagged as PD, with the other one from COMELEC via the COC submitted by the candidate. @Howard the Duck: None of these seem to be taken by "an officer or employee of the Government of the Philippines [...] as part of their regularly prescribed official duties". These photos are likely taken by social media managers of each respective candidate. For candidates who are currently elected (if any), then it might be reasonable to assume that they're employed by their office, though the attribution would still be incorrect here as obviously these politicians are not taking photos of themselves. Also there's a question of official photo shoots where the photos may be contracted to a third party. Would those be "an officer or employee of the Government of the Philippines"? Howard the Duck (talk) 23:49, 10 February 2026 (UTC)[reply] Social media managers are sometimes on the payroll as the office's communications/press staff, but that's not surefire and there's no way to tell. Works by contractors hired by the Government may still be covered by copyright, as commissioned works keep their copyright (specifically with the creator of the work; e.g. the photographer of the portrait or their company, if employed) unless there's an agreement to the contrary. The Government also does not automatically lose copyright for all works whose ownership is transferred to it; that's a specific exemption for Government copyright under Section 176.3 of the IPC. I think the bigger question there is whether one can ascertain that the photo was, in fact, taken by a third party. In my experience, many government agencies have internal staff that serve public communications functions, who normally take up the role of being photographers for official portraits. Works by political parties or their campaign team aren't government works. For incumbent officials this gets murkier. This needs updating, in light of recent arrest of a Mongolian jet pilot student in Zambales due to his ties with a mainland Chinese school. Relevant news articles concerning a certain "Boldbaatar Bold-Erdene": PhilStar source and GMA News source. I'll leave all the job to other Pinoy editors.

I am reiterating my refraining to contribute on content/articles concerning Philippines and China+Beijing's ally countries like Mongolia, since I "may be" under "lowest level" of "monitoring" by other editors right now, in light of my recent edits that have been construed as having pro-Manila stance (thereby breaching WP:NPOV), despite being a FilChi/Chinoy myself and in person. Imo I think this is WP:UNDUE and WP:NOTNEWS, the pilot student just happens to be Mongolian. I'll wait until the Mongolian foreign ministry or the DFA to address Mongolia first and then consider if its worth to include it. Hariboneagle927 (talk) 04:11, 20 February 2026 (UTC)[reply]
